What is Personal Conveyance?
Personal conveyance is the movement of a commercial motor vehicle (CMV) for personal use while off-duty. A driver may record time operating a CMV for personal conveyance as off-duty only when the driver is relieved from all responsibility of performing work. The CMV may be used for personal conveyance, even if it is loaded, but only when the load is not being transported for the commercial benefit of the contractor. Personal conveyance does not reduce a driver’s or motor carrier’s responsibility to operate a CMV safely.
What is CloudTrucks' Personal Conveyance Policy?
CloudTrucks Policy allows a contractor to utilize personal conveyance for up to 70 miles/week without notifying the carrier. Personal Conveyance in any given week that exceeds 70 miles, should be discussed prior to avoid improper or illegal use of personal conveyance.
If you exceed the 70 mile/week rule and fail to discuss the situation with Safety prior, your personal conveyance privilege will be shut off for 7 days for the first offense, 14 days for the second offense and 21 days for the third offense. If you continue to violate the personal conveyance rules thereafter your personal conveyance will be completely shut off.
Examples of appropriate uses of a CMV while off-duty for personal conveyance include:
- Time spent traveling from lodging to restaurants and or shopping centers
- Commuting between residence to & from trailer-drop lots when no longer under a load
- Time spent traveling to a nearby, reasonable, safe location to obtain required rest after load or unload. (Max. 70 miles) Full DOT break must still be taken after arrival at a safe location prior to returning to duty.
- Moving a CMV at the request of a safety official during the driver’s off-duty time
- Time spent transporting personal property while off-duty (HOS rules still apply)
- Authorized use of a CMV to travel home after completion of load (No limit set by carrier but Personal Conveyance should not be used to extend past 14 hr. rule and full break must be taken prior to selecting new load)
Personal Conveyance is strictly prohibited in these situations:
- Moving a CMV to enhance operational readiness of load (Example: bypassing available rest locations in order to get closer to the next load or unload point)
- Continuation of any movement for a business purpose, including bobtailing or deadhead to retrieve another load
- Time spent transporting a CMV to a facility to have vehicle maintenance performed
- After being placed OOS for exceeding the maximum periods permitted under part 395, time spent driving to a location to obtain required rest
